Rai Fink Ebner attorney Blake Gantt represented a landscape contractor who worked at a residential property. The neighbor then filed arbitration alleging various violations of city regulations. Our client was brought into the arbitration as a third-party defendant. Third-party Plaintiff sought claims for common law indemnity.
Gantt filed a motion for summary judgment and successfully argued that Third-party Plaintiff failed to properly tender their claims for defense and indemnity and never provided our client with an opportunity to assume their defense. The arbitrator granted our motion. This prevented over $200,000 of claims for defense costs and damages.
