Rai Fink Ebner attorney Rina Rai defended several subcontractors in a construction defect suit. She filed a motion for summary judgment arguing that the developer did not properly tender their claims for defense and indemnity. Rai argued that the invalid or insufficient tender of defense barred all indemnity claims. She obtained dismissal of all claims by the developer against our clients. The matter subsequently settled for satisfaction of additional insured obligations and an agreement to forgo appeal.
