Rai Fink Ebner attorneys Rina Rai and Tom Duer represented a concrete subcontractor in a construction dispute stemming from a Tucson-area home build. The homeowners sued the subcontractor for breach of contract and fraudulent misrepresentation over concrete work on the home’s back patio and foundation. Rai and Duer obtained summary judgment for our client at the trial court, successfully arguing no contractual privity existed between our client and the homeowners, and secured an award of attorney fees and costs. The Arizona Court of Appeals affirmed both the summary judgment ruling and the fee award, and further awarded the client its attorney fees incurred on appeal.
