Rai Fink Ebner attorneys Rina Rai and Tom Duer secured a defense verdict in a personal injury case involving an alleged mild traumatic brain injury (mTBI). They represented a municipal bus carrier and its driver after a rear-end collision that was caused by the driver having a medical event. The plaintiff sought $405,000 in damages.
At trial, strategic preparation and cross-examination allowed us to highlight inconsistencies in Plaintiff’s evidence for the jury and demonstrate that the plaintiff’s expert opinions rested on incomplete and inaccurate information. Further, despite having no cooperation or testimony from the driver, our team successfully presented a sudden-incapacitation defense. After three days of trial, the jury returned a full defense verdict for both defendants.
